1. General

These General Terms and Conditions of Use apply to every use of the website www.weinvest.be and all its secondary sites (hereinafter referred to as the "Website"), as well as to any other service offered by BV We Invest Real Estate with registered office at 1160 Auderghem, Place Communale d' Auderghem 8 (hereinafter referred to as "We Invest" or "We"), company number BE.0550.728.089, owner and manager of the Website.

The notion of "Service" as used in these General Terms and Conditions of Use, refers to all of the Website - visits and/or uses - as well as to any other service that We offer on or via the Website. By simply using the Service, you acknowledge having read and accepted these General Terms and Conditions of Use (hereinafter referred to as "GTCU").

These GTCU may be amended or revised at any time. Amended or revised GTCU are applicable as soon as they are published on the Website. We Invest reserves the right to modify or discontinue (part of) the Service at any time, temporarily or permanently, with or without prior notice.

2. Legal information

We Invest Real Estate BV, an IPI-approved real estate agency (Belgium - no. 507 630) with registered office at 1160 Auderghem, Place Communale d'Auderghem 8. Company number BE.0550.728.089 (rpm Brussels).

As a real estate agency, We Invest is subject to the supervision of the IPI (Institut professionnel des Agents Immobiliers), established at Rue du Luxembourg 16b, 1000 Brussels, and must respect the code of ethics governing the profession of Real Estate Agent.

The We Invest agency has its operational headquarters at its registered office.

3. Use of the Service

You must be 18 years of age or older to use the Service. Minors wishing to use the Service must be accompanied by at least one of their parents. In the case of a minor using the Service without parental supervision, we are not liable in any way.

The user uses the Service at his or her own risk. The Service is provided on an "as is" and "as available" basis.

As a user of the Service, you declare that you have understood and accepted the following prohibitions:

  • It is forbidden to collect and/or use the user names, passwords, e-mail addresses or other personal data of users for any purpose whatsoever.
  • Except with the explicit and prior written consent of We Invest, the use of "metatags" is prohibited.
  • It is forbidden to use the Service for unlawful advertising purposes, including by means of spam, chain letters or unwanted e-mails.
  • The use of data mining, robots, screen scrapers or similar data gathering tools on the Service is prohibited without the explicit and prior written consent of We Invest. The use of "collating" or "collating techniques" in any part of the Service is prohibited without the explicit written permission of We Invest.
  • It is prohibited to copy, duplicate, reproduce, sell, resell or exploit any part of the Service, the use of the Service or the access to the Service without the explicit and prior written permission of We Invest.
  • It is forbidden to download or post spam.
  • It is prohibited to upload, post or send worms, viruses or any other code of a destructive nature.
  • It is prohibited to modify, adapt or hack the Service, or modify a third party's website to give the impression that it is associated with the Service offered by We Invest.
  • It is forbidden to use the Service for any illegal or illicit purpose. When using the Service, it is prohibited to exceed the limits of applicable law (including, but not limited to, the provisions relating to copyright and database law).
  • It is forbidden to use the Service for commercial purposes; only private use of the Service is permitted.

However, it is permitted to create a "hyperlink" from your own website to the homepage of Our Website. If you wish to create a "deep link" to specific content on Our Website, you must first obtain Our explicit and prior permission to do so.

It is possible that, when using the Service, We may send you "cookies", originating from the domain weinvest.be. Reliability of the information contained on the Website

Although we aim to ensure that the information and other content that you may find on or via the Service is reliable, up-to-date, complete and accurate, we cannot under any circumstances be held liable for any direct or indirect damages, in particular material, immaterial or other damages, resulting from the use of the information and other content of the Service. The same applies to files downloaded via the Website. In particular, We make every effort to regularly update the property listings on Our Website. Nevertheless, We cannot be held responsible if errors are made in the content of the advertisement or if the property is no longer available at the time you consult the advertisement. We Invest intends to respect intellectual property rights at all times. The holders of these rights may inform We Invest at any time if they believe that We Invest itself or a user of the We Invest Service is ignoring their rights. In this respect, please clearly indicate the content protected by intellectual property rights and the URL of the information on the Website that has been violated or constitutes an infringement, as well as sufficient contact details allowing us to get in touch with you (address, e-mail address, telephone number).

5. Limitation of liability

You agree and acknowledge that We Invest cannot and will not be liable for any direct or indirect damages, secondary or special damages, consequential or incidental damages, including, but not limited to, damages for loss of profits, goodwill, use, loss of data or other intangible losses, as a result of:

  • Failures, interruptions or errors in the provision of electronic services, services or information obtained through the Service;
  • Error and/or negligence on the part of We Invest employees and/or agents of, with the exception of possible ethical liability in the event of a breach of the ethical rules of the Institut professionnel des Agents Immobiliers,
  • Fraudulent falsification of data by third parties resulting from unauthorised intrusions on the Website,
  • Statements or behaviour of third parties on the Website,
  • The inability to use the Service,
  • Unauthorised access to or modification of your data transmission or contact details.

6. Other terms

If We Invest does not enforce a right or provision (arising) from these GTCU, this does not mean that it waives this right or provision.

If one or more aspects of these GTCU are (or appear to be) totally or partially unenforceable, the validity and binding nature of the other provisions shall remain unaffected.

In the event of a conflict between these GTCU and any special conditions applicable to certain services provided by We Invest, whether or not via the Service, the special conditions shall apply.

These GTCU are governed by Belgian law. The parties agree that in the event of any dispute relating to the Service (including these GTCU), the courts of Brussels shall have sole jurisdiction.
